1. Definitions
- FirmTrove, we: Gottmer Webshops, KvK 73444111, which provides the service.
- User, you: the person or organisation that creates an account or uses the service.
- Service: the explorer at app.firmtrove.nl, the REST API and the MCP server, with the company database made available through them.
- Data: the company information the service delivers to you.
- Fair-use policy: the policy at firmtrove.com/en/legal/fair-use/, which forms part of these terms.
2. When these terms apply
These terms apply to business use of the service. This version applies to a new account that affirmatively accepts it on or after 6 October 2026. An account with an earlier acceptance receipt remains governed by the version it accepted until valid notice and, where required, new acceptance have taken place. We do not rewrite existing acceptance receipts. Your own general terms do not apply.
3. Your account
The service is for businesses; users must be 18 or older. An account belongs to one person or one organisation. As owner you may add up to five team members. They work within your plan and limits. You keep login details and access keys within that team and are responsible for use under your account.
You do not create extra accounts to get around the free allowance or a limit. If several accounts turn out to belong to the same user, we may merge or close them.
4. Plan, prices and payment
Pro: €29 a month excluding VAT. Start with 5,000 rows, adding 2,500 each consecutive paid month, up to 25,000 per calendar month. Pro Year: €290 excluding VAT paid upfront, with 25,000 per calendar month from day one.
Free costs nothing and has 100 rows per calendar month. Monthly prices are paid each month in advance; the full annual price is paid upfront. We announce a price change at least 30 days in advance. It applies at the next renewal. Unpaid subscriptions lose paid access.
5. Term and cancellation
Stop renewal from your account. Access lasts until the end of the paid month or paid year. You then return to Free. We do not automatically refund the remaining period. A monthly subscription that ends starts again at 5,000 rows for a new consecutive paid subscription. Existing paid accounts retain 25,000 rows per calendar month.
6. What you may do with the data
You receive a non-exclusive, non-transferable right to use data delivered by FirmTrove for your own business purposes, such as prospecting, enriching your own records and market research. That right lasts while your account is active.
You do not sell, publish or pass on the database or parts of it, use it to build a competing dataset or search service, systematically retrieve it outside the documented API, or bypass limits or security. These terms provide no general licence to supply data to others.
Source material under an open licence may give you broader rights directly. These terms do not restrict those rights. You must comply with the applicable licence, including any attribution, licence-link and change-notice requirements.
7. Fair use and access
Free has 100 rows per calendar month. CSV, REST and MCP share one allowance per account, including team members and multiple keys. Every exported CSV row counts, including a new export of the same company. REST and MCP count each delivered company ID once per calendar month, across keys and calls. That ID counts again in the next month. Downloading an existing export again uses no extra rows. Searching, filtering and viewing company records in the browser uses no allowance; rate limits apply. Per account, the limits are 30 searches and 60 detail requests per minute; IP limits are four times those amounts. Browser, REST and MCP share these rate limits. Exceeding the limits first throttles requests. The third renewed violation locks the account until manual review; it does not unlock automatically. Pro exports allow at most 5,000 rows and Free exports at most 100, within the remaining allowance. The allowance resets at 00:00 UTC on the first day of each calendar month and unused rows expire. Existing paid accounts retain 25,000 rows per calendar month.
An allowance does not grant the right to retrieve the entire database. Use only the documented API and MCP tools. We may apply rate limits to prevent abuse. We announce any reduction in included allowance at least 30 days in advance.
8. Origin, coverage and accuracy
The service combines our own observations of company websites with information from official, open and commercial sources. FirmTrove keeps internal evidence of origin, observation and use conditions. Where a licence requires attribution or another notice, we provide it with the relevant data or export. We do not display supplier or internal evidence details for every field where that is unnecessary or not permitted.
We try to keep data current and accurate, but do not guarantee that it is complete, correct or suitable for your purpose. A date states when something was observed and does not prove its current state. A missing field may be unknown, unavailable or withheld because of an applicable restriction. It does not prove the attribute does not exist. Published counts are dated selections, not promises of nationwide coverage.
9. Conditions on delivery
Whether a field is delivered depends on applicable use rights, privacy and objections, security, suppression, freshness and your account entitlement. A broad source or privacy label does not decide this by itself. Some fields may therefore be absent or show a specific limitation. You may email hello@firmtrove.com to ask for an explanation or an available, lawfully deliverable alternative.
You keep required attributions, licence links and other notices with the data and pass them on where the applicable licence requires it. Your use or acknowledgement does not remove our own duties to data subjects, sources and licensors. Access to the service is not permission for unsolicited marketing or any other unlawful use.
10. Personal data and roles
FirmTrove independently determines the purposes and means of collecting and supplying company data and administering accounts. FirmTrove is an independent controller for that processing. You independently determine the purposes and means of your later use of delivered personal data and are the controller for that use. You comply with the GDPR and Dutch Telecommunications Act, respect objections and check before contacting someone whether that contact is permitted.
When you contact someone whose details you got through FirmTrove, your first message says you got them through FirmTrove and gives the link firmtrove.com/en/am-i-listed, where that person can have themselves removed. A ready-made sentence is shown with your export and in the API documentation. When someone has had themselves removed from FirmTrove, you delete or suppress them in your own records too. You get that list through the API or the MCP server; new exports no longer include these people.
This service does not make FirmTrove your processor for personal data. If a separate service later involves processing on your behalf, we will agree appropriate terms for that service. Our processing, corrections and rights requests are described in the privacy statement and on the correction page.
11. Availability, support and confidentiality
We try to keep the service available, but promise no uninterrupted availability and provide no SLA. Maintenance, supplier outages and necessary security work may interrupt it. For support, email hello@firmtrove.com; we promise no fixed response time.
Each party handles non-public business information, account information and access keys received through the service with care and uses them only for the agreement. This does not apply to information that was already public, was lawfully received from another party, was developed independently or must be disclosed by law.
12. Suspension, termination and export
We may limit, suspend or terminate your access if you breach these terms or the fair-use policy, payment is not made, or your use harms the service or others. We may act without advance notice where there is an acute risk. You see the reason when you log in and may respond through hello@firmtrove.com. If the suspension was incorrect, we restore the account.
While your account is active, you may export permitted selections within your plan. Download what you need before the end date; after closure sessions and access keys are revoked and we promise no further access to previous exports. Account deletion, fiscal retention duties and rights requests are handled under the privacy statement.
13. Intellectual property
The service, software and our own compilation and structure belong to FirmTrove or our licensors. You receive only the right of use in section 6. The rights and conditions of separate source material continue to apply; these terms do not restrict applicable open licences.
14. Liability
Our liability per event and per year is limited to the amount you paid for the service in the twelve months before the loss. We are not liable for indirect or consequential loss, lost profit or lost savings.
These limits do not apply in the event of intent or wilful recklessness on our part, or where mandatory law prohibits the limitation.
15. Changes
We may change these terms and the fair-use policy. We announce a change that materially disadvantages you at least 30 days in advance by email or in the explorer. If you disagree, you may cancel before the effective date. New wording does not change an earlier acceptance receipt.
16. Governing law
Dutch law applies to these terms. A dispute will be submitted to the competent court in the district where we are established, unless mandatory law requires another court.
